Question 1:
I realize that you guys are not releasing tools because there is no point, but are there any laws or restrictions holding you back from releasing anything? do you fear any possible consequences that may happen as a result of releasing tools?

I know it is impossible, and there is no TDATA modding allowed on these forums but what if(hypothetically speaking) some one were to release a resigner for Halo 3 maps could said person face criminal charges?(please don't make a reply saying "NAWT PAWSIBLE DON EVEN ASK" because I am asking what if it happened as in I know it will never happen)

Yes when con resigner, forge map editors and film editor, were realsed xbox live went down as well as bungie.net people lost their jobs, that's where the economic crisis really started when some kids posted pr0n images on fileshares and it,all this,was going to end up with the end of the world as predicted by the Gods of Halo Modding.
But Bungie quickly fixed it and it was allright, people kept modding but without putting modded content on their file share and they all lived happy for the rest of their lives.

What about all the disassemblers, hex editors, etc made? The guy who made IDA doesn't have any "legal implications" against or on him. It's about who uses the tool and for what purpose. If you were to use say, IDA to reverse engineer a program *just* to steal it's code, then you use that code and put it in your own program, then that would set you up for possible legal implications.
As for that theoretical if statement, it all depends on how the private key, needed in order to generate a valid signature, was obtained in the first place. If it was stolen or leaked, there could be "legal implications" for all parties. However, if someone just managed to stumble upon the right parameters for generating the private key, there would be no strings attached. No strings attached until the actual use of the resigner that is. It's part of the license agreement not to circumvent any protection in place (board generalization of that section of the license agreement).
Look at the Luigi guy who found all the exploits in Halo PC (and many, many other games). He not only published the facts on the exploits, but posts tools to perform them as well, but is he the using these tools for mischievous use?...
Just because you own a gun doesn't automatically mean you're a killer. You can't be charged for murder with that gun until you actually use that gun, a tool, for ending someone's life.

Would the splash effect, item float effect, and underwater effect follow it or would it stay where the original water level was? In Halo 2 the splash effect stayed there when you raised the water because it was a plane, but I want to know if it is different in Halo 3.
