What if bungie just made it so that the banhammer would go on only when you tried accessing the matchmaking playlist??

Then you could still play in custom games, and then delete your mods and go legit in matchmaking

This has been discussed before and I believe the reason they will never do it is because modding/cheating like that is against the Xbox Live Code of Conduct, and Bungie doesnt own Microsoft, so cheating is against Xbox Live itself.

I think Modding isnt anything bad for xbox live. All my friends love when i start modding, such as spawning gates, Flying Wharthog, Elites, and make everyone run super fast, and Jump super high. I think the only heart modding does is when modders go into matchmaking. Infact, the only reason why the banhammer exist is because of cheaterse, and then they complain on why they cant play only in custom games and not get banned
