If you mod only in custom games (on halo 2 xbox) can your account get banned.... if your account gets banned can you make a new one or is that not possible?

Dont play on live with mods.. thats all i can say.

Yes you can, and will get banned from XBL if you are Modding. We don't talk about Modding on XBL here.

even if your modding on live u won't be banned from custom games, only matchmaking, so it shouldnt matter if your only modding on custom games

you can get banned anywhere on XBL for modding. If you wanna play a modded game, go on XBC and do it.
